Welcome to ChallanFree. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and ChallanFree Technologies Pvt. Ltd. ("ChallanFree", "we", "us", or "our"), governing your access to and use of our website at www.challanfree.com and all related services.

By accessing our website, submitting an application form, making a payment, or otherwise engaging with our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

ChallanFree provides motor vehicle traffic challan resolution services across Delhi NCR, including Noida, Greater Noida, and Ghaziabad. Our services include:

• Challan Lookup: Fetching outstanding traffic challans against a vehicle registration number from government portals (Parivahan, traffic police databases).
• Legal Representation: Engaging empanelled advocates to appear in traffic courts and seek reduction or dismissal of challans on your behalf.
• Court Liaison: Managing case filings, hearing dates, and updates on your behalf.
• Advisory: Providing general guidance on traffic challan procedures under the Motor Vehicles Act, 1988.

To use our services, you must:

• Be at least 18 years of age.
• Be the registered owner of the vehicle, an authorised representative, or have explicit written consent of the owner.
• Provide accurate, current, and complete information about yourself and the vehicle.
• Not be prohibited from receiving legal services under any applicable Indian law.

By submitting an application, you represent and warrant that you meet all eligibility requirements. We reserve the right to decline service to any person who does not meet these criteria or who provides false information.

When using our services, you agree to:

Accurate Information

• Provide truthful and complete information in your application, including your name, contact details, vehicle registration number, and challan details.
• Promptly update us if any submitted information changes during the course of your case.
• Not misrepresent your identity, ownership of the vehicle, or the nature of the challan.

Cooperation

• Remain reasonably available for communication from our team and the assigned advocate.
• Provide any additional documents, authorisations, or information reasonably requested to process your case.
• Execute a Power of Attorney or Vakalatnama if required for legal representation.

Timely Payment

• Pay the applicable service fee in full before we commence work on your case.
• Pay any government-imposed fines, court fees, or challan amounts directly; our fee covers only legal representation, not fines.

All payments are processed securely via Razorpay. We accept UPI, credit/debit cards, and net banking. Prices are inclusive of applicable GST unless stated otherwise.

Our refund policy is as follows:

• Full Refund: If we are unable to commence your case due to our own inability (e.g., no advocate available in your area), you are entitled to a full refund within 7 business days.
• Partial Refund: If you cancel after we have commenced preliminary work but before court appearance, a partial refund of 50% of the service fee may be issued at our discretion.
• No Refund: Once an advocate has appeared in court on your behalf, no refund is applicable — regardless of the case outcome.
• Outcome-Based: Refunds are not provided on the basis of case outcome. A dismissal, reduction, or unsuccessful result does not entitle you to a refund (see Section 7).

ChallanFree provides legal facilitation services, and the outcome of any traffic challan case is determined solely by the relevant court or traffic authority. We make no representations, warranties, or guarantees regarding:

• The dismissal, reduction, or cancellation of any challan or fine.
• The timeline for case resolution, which depends on court schedules, government portals, and hearing dates beyond our control.
• Specific outcomes promised verbally by our agents (unless confirmed in writing).

Our advocates will exercise their best professional judgment and skill; however, legal proceedings involve inherent uncertainty and we shall not be held liable for any unfavourable outcome.

All content on our website — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software — is the property of ChallanFree Technologies Pvt. Ltd. and is protected under Indian copyright law.

• You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from our website without prior written consent.
• The "ChallanFree" name, logo, and brand marks are registered trademarks. Unauthorised use is prohibited.
• Personal, non-commercial use of website content for informational purposes is permitted, provided you do not remove any copyright or proprietary notices.

You agree not to use our services or website to:

• Submit false, misleading, or fraudulent information or documents.
• Impersonate another person or misrepresent your authority to act on behalf of a vehicle owner.
• Attempt to manipulate, harass, or intimidate our staff, advocates, or court officials.
• Use our platform to engage in any unlawful activity under Indian law.
• Scrape, crawl, or systematically extract data from our website without authorisation.
• Attempt to gain unauthorised access to our systems, databases, or backend infrastructure.
• Circumvent or attempt to bypass our payment systems.

Violation of any prohibited conduct may result in immediate termination of services, forfeiture of fees, and reporting to relevant authorities.

To the maximum extent permitted by applicable Indian law, ChallanFree and its officers, directors, employees, advocates, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
• Loss of income, profits, business, or data arising from reliance on our services.
• Delays or failures caused by court closures, government portal downtime, strikes, natural disasters, or other events beyond our reasonable control.
• Actions or omissions of third-party payment processors, government portals, or courts.
• Any unfavourable legal outcome, fine, or penalty imposed by a court or traffic authority.

Our total aggregate liability to you for any claim arising from these Terms or our services shall not exceed the service fee actually paid by you for the specific case in question.

You agree to indemnify, defend, and hold harmless ChallanFree Technologies Pvt. Ltd. and its officers, directors, employees, advocates, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your violation of these Terms.
• Your provision of false, inaccurate, or misleading information.
• Your infringement of any third-party rights, including intellectual property or privacy rights.
• Any misuse of our platform or services.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms shall be subject to:

• Negotiation First: Parties shall attempt to resolve disputes amicably within 30 days of written notice.
• Arbitration: If negotiation fails, disputes shall be referred to a sole arbitrator under the Arbitration and Conciliation Act, 1996, with proceedings conducted in English in Noida, Uttar Pradesh.
• Jurisdiction: Courts in Noida, Uttar Pradesh, India shall have exclusive jurisdiction for any matter not subject to arbitration.

ChallanFree reserves the right to suspend or terminate your access to our services, with or without notice, in the following circumstances:

• Violation of any provision of these Terms.
• Provision of false, fraudulent, or misleading information.
• Non-payment of applicable fees.
• Abusive, threatening, or harassing behaviour toward our staff or advocates.
• Any activity that may expose ChallanFree to legal liability.

Upon termination, your right to use our services ceases immediately. Any ongoing case may be discontinued, and fees already paid may be forfeited if termination is caused by your breach of these Terms.

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page.
• Send an email notification to users with active cases if changes materially affect them.
• Display a notice on our homepage for 30 days following significant updates.

Your continued use of our services after any modification constitutes your acceptance of the updated Terms. We encourage you to review this page periodically. If you disagree with any changes, you must discontinue use of our services.
